Terms and Conditions for Users

Welcome to Campus Eats ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Campus Eats mobile application and related services (collectively, the "Service"). By registering an account and/or using the Service, you ("you" or "User") agree to be legally bound by these Terms. Please read them carefully before using our platform.

1. Introduction and Acceptance

Campus Eats provides an online food ordering platform designed to connect users with various food outlets across multiple campuses in India. Our Service enables users to place orders for pickup or delivery, schedule orders, and make payments via an in-app wallet system.

By accessing or using the Campus Eats Service, you acknowledge that you have read, understood, and agreed to these Terms, as well as our separately maintained Privacy Policy. If you do not agree with any provision in these Terms, please do not use the Service.

2. Eligibility and Account Registration

2.1 Eligibility

You represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into these Terms. The Service is restricted to individuals meeting this age requirement. Use by minors under 18 is strictly prohibited.

2.2 Account Creation and Security

To place orders and use most features, you must register and create an account. Registration requires providing a valid phone number, which will be verified by SMS. Additionally, you must supply your name and email address during onboarding; providing your date of birth and gender is optional.

You are responsible for maintaining the confidentiality of your account login credentials and for any activity conducted using your account. You agree to notify Campus Eats immediately of any unauthorized use or suspected security breach related to your account.

3. Service Description

3.1 Platform Functionality

Campus Eats offers a digital marketplace where users may:

• Select their campus and browse participating food outlets.
• View menus and customize orders by selecting add-ons and item variants.
• Place orders for either pickup or delivery.
• Schedule orders for future fulfillment.

3.2 Payment Processing

Payments are made through an in-app wallet system. Users must top up their wallet balance via supported payment methods such as credit cards, debit cards, UPI, or net banking before placing orders.

3.3 Registration of Outlets and Access

Any campus or food outlet meeting the registration requirements can onboard onto our platform. The Service is open to the general public and not limited solely to students or campus members.

4. Payments, Charges, and Refunds

4.1 Payments and Platform Charges

All wallet top-ups and transaction payments are processed using secure payment gateways. Platform fees or convenience charges are applied to transactions as disclosed.

4.2 Refunds and Cancellations

A detailed refund policy is maintained separately and will be referenced in your transactions. Users are encouraged to review the refund policy to understand the terms governing cancellations, returns, and refunds.

4.3 Order and Transaction History

Users can view their complete order records and wallet transaction history within the app's "Orders" and "Wallet" sections.

5. User-Generated Content and Conduct

5.1 User Content Submission

Users may post reviews, ratings, and comments related to food outlets, menu items, and delivery experiences. This content must adhere to community standards and appropriate conduct.

5.2 Content Guidelines and Moderation

Submitted content must not contain offensive, hateful, discriminatory, or illegal material. Campus Eats reserves the right to moderate, approve, or remove any user content that violates such guidelines. Moderation procedures include automated filters and manual reviews.

5.3 User Account Suspension

Accounts engaging in fraudulent orders, abusive behavior, repeated payment disputes, or posting prohibited content may be suspended or terminated. Users are currently encouraged to report violations via support channels; formal user reporting mechanisms may be introduced in future updates.

5.4 Rights Over User Content

Published user reviews will display the user's first name and avatar. Users retain the right to edit or delete their contributions at any time.

6. Platform Responsibilities and Limitations

6.1 Vendor Responsibilities

Campus Eats acts solely as a platform facilitator and is not responsible for vendor-related matters including food quality, ingredient accuracy, allergen information, or compliance.

6.2 Dispute Resolution Between Users and Vendors

All complaints and disputes concerning food quality or vendor services must be resolved directly between the user and the vendor. Campus Eats does not mediate or intervene in such issues.

6.3 Service Availability

The platform and its services are provided "as is" with no guarantees of uptime, order accuracy, or fulfillment timelines.

6.4 Modification of Terms

We reserve the right to modify these Terms at any time. Material changes will be notified to users via the registered email address. Continued use after notification constitutes acceptance of the updated Terms.

7. Legal and Compliance

7.1 Governing Law and Jurisdiction

These Terms and your use of the Service are governed exclusively by the laws of India. Any disputes will be subject to the jurisdiction of Indian courts.

7.2 Dispute Resolution

You agree to first seek amicable resolution through negotiation with Campus Eats. If unresolved within 30 days, disputes shall be resolved by binding arbitration conducted under the Arbitration and Conciliation Act, 1996. Arbitration will occur in the location of Campus Eats' headquarters and be conducted in English.

7.3 Limitation of Liability

Except as required by law, Campus Eats excludes liability for indirect, incidental, consequential, or punitive damages, including lost profits or data. Our total liability, if any, is limited to the amount you have paid Campus Eats in the six months prior to the claim.

7.4 Intellectual Property Rights

All trademarks, logos, software, designs, and other content on Campus Eats are protected and owned by Campus Eats or its licensors. You may use such intellectual property only for personal, non-commercial purposes as permitted. Unauthorized use may lead to account termination and legal consequences.

8. Communication and Support

8.1 Support Channels

You may contact Campus Eats customer support via email, phone, website contact form, or support ticket system.

8.2 Marketing Communications

Campus Eats may send transactional and promotional communications through email, SMS, push notifications, or other channels.

8.3 Opt-Out Rights

You may opt out of receiving marketing and promotional communications at any time by following unsubscribe instructions or contacting support.

8.4 Response Times

Campus Eats endeavors to respond to support inquiries within 1 to 2 business days.

9. Additional Terms

9.1 User Conduct and Prohibited Uses

Users agree not to misuse the Service for unlawful acts, impersonation, fraudulent behavior, unauthorized access, or reselling orders. Disruptive behavior interfering with other users' access is prohibited.

9.2 Account Security

Users are responsible for securing their account credentials and promptly notifying Campus Eats of any unauthorized account usage.

9.3 Indemnification

You agree to indemnify and hold harmless Campus Eats, its affiliates, and employees from any claims or liabilities arising from your violation of these Terms or misuse of the Service.

9.4 Force Majeure

Campus Eats is not liable for any delays or failure to perform due to circumstances beyond its reasonable control, such as natural disasters or government actions.

9.5 Severability

If any part of these Terms is found unenforceable, the remainder shall remain valid and enforceable.

9.6 Entire Agreement

These Terms and the corresponding Privacy Policy represent the entire agreement between you and Campus Eats concerning the use of the Service and supersede prior agreements or communications.
